AutoMaxx, a now out-of-business Houston company that was the subject of a brokering complaint by the state department of motor vehicles, had challenged the antibrokering law's constitutionality. AutoMaxx lost their argument in Federal court, with the law being upheld.
AutoMaxx had referred credit union members to dealers who agreed to:

- Not offer additional services to members
- Not tell customers that other lending sources might have lower interest rates
