Checking Regulations




In our continuing effort to keep you abreast of changes and potential changes in state and federal laws concerning checks we felt you should be aware of some of the pending legislation by state.


Oklahoma-HBN 2352 (Weaver). Relates to the consumer credit code, and to the return of dishonored checks; modifies fee which may be charged for dishonoring certain checks; provides for Administrator to establish fee by rule; establishing minimum fee amount. Prefiled 1/12/96.


Pennsylvania-SBN 1312 (Heckler/et al.). Amends the Crimes and offenses Code. Further provides for bad checks by requiring that certain suspects be fingerprinted in order to determine prior bad checks violations. Introduced 11/21/95; To Senate Committee on Judiciary 11/21/95.


Pennsylvania-HBN 2285 (Tangretti/et al.). Amends the Crimes Code. Further provides for the grading of issuing or passing of bad checks. Introduced 12/12/95; To House Committee on Judiciary 12/13/95.


Tennessee-HBN 1312 (West). Specifies that if the name, home address, and home phone number of the presenter are listed on a bad check then this information constitutes prima facie evidence of the identity of the party and can be used as such in prosecution. Introduced 1/19/96.


Utah-SBN 56 (Buhler). Relates to financial institutions; Increases the dishonored instruments service charge; and makes technical corrections. Introduced 1/15/96; To Senate Committee on Business, Labor and Economic Development 1/18/96.
