FDCPA Amended
A major modification in the Section 807(11) Mini-Miranda warning
provision of the Fair Debt Collection Practices Act (FDCPA) was
enacted into law, effective January 1, 1997. The change provides that
debt collectors will no longer be required to give the Mini-Miranda
disclosure, "This is an attempt to collect a debt and any information
obtained will be used for that purpose" in every oral or written
communication. Instead, the warning will now only have to be provided
"in the initial written communication and, in addition, if the
initial communication with the consumer is oral, in that initial oral
communication."
After the initial communication, collectors will now only have to
disclose "that the communication is from a debt collector."
