Landmark $100 Million Settlement Reached in Equifax Credit Score Misreporting Class Action Lawsuit; Gibbs Mura is Co-Lead Counsel on Behalf of 4 Million Estimated Class Members

OAKLAND, Calif.--(BUSINESS WIRE)--On August 17, 2026, a federal judge granted preliminary approval to a $100 million settlement in a class action lawsuit against Equifax brought by Gibbs Mura and co-counsel alleging it miscalculated credit scores affecting approximately 4 million people in 2022. This is the largest settlement in history related to the Fair Credit Reporting Act (FCRA) and a landmark achievement in consumer protection. Gibbs Mura partner David Berger, court-appointed to co-lead the case, was instrumental to negotiating the settlement.

The class action lawsuit, In re: Equifax Fair Credit Reporting Act Litigation (Case No. 1:22-cv-03072), received preliminary approval by the Honorable Leigh Martin May in U.S. District Court for the Northern District of Georgia. A final fairness hearing is scheduled for January 22, 2027. Gibbs Mura serves as class counsel together with co-counsel Girard Sharp, DiCello Levitt, and Caplan Cobb.

What was the Equifax Credit Score Error Lawsuit About?

According to the lawsuit, Equifax misreported lowered credit scores for approximately 4 million Americans who applied for mortgages, auto loans, or credit cards between March 17 and April 6, 2022. As reported by the news, Equifax sometimes reported scores lowered by over 20 points, enough to cause lenders to deny credit or charge consumers higher interest rates.

The lawsuit alleged that Equifax was reckless in relying on antiquated legacy systems and inadequate testing systems, charging the company with violating the Fair Credit Reporting Act.

The $100 million settlement will provide direct cash payments to the approximately 4 million class members. The settlement fund is non-reversionary, meaning unclaimed funds will not go back to Equifax.
